Before-Filing-Bankruptcy--Different-Types-of-Bankruptcy--Fast-Track-Debt-Relief 10 Things to Consider Before Filing Bankruptcy

Before filing bankruptcy, you need to ask yourself a few important questions. Many people in debt feel pressure to take this route before they really understand the process. This can force them into an even worse situation. There are also different types of bankruptcy, and it's crucial to know the difference. While you are exploring your options, consider these 10 key points.

  1. Communicate with Debt Holders

People panic when they're in debt; they hide from credit card companies, lenders, and other debt holders. This is understandable – debt's scary. Understandable, but not helpful. Pick up those calls and explain your situation, even if it's just to say you can't make a payment. Creditors will know you aren't hiding from them, and they may even be able to reduce your interest rates or offer a hardship program you didn't know about.

At the very least, your heart won’t race whenever the phone rings. This in itself is a significant relief.

  1. You Have Alternatives

People in debt too often see bankruptcy as their only solution. When they think this, they don't even ask themselves if better alternatives exist.

Bankruptcy is a last resort; there are options such as debt relief programs that can help you avoid taking this drastic step - and dealing with the long-lasting consequences.

  1. Be Open to Learning

Society sometimes assumes people in debt are bad at handling finances. Yet many bankruptcies are the result of medical or other emergency debt. It's often bad luck, not bad habits, that land folks in trouble.

Nonetheless, now you're in a new situation. You're in debt, and that means learning how to create or change how you manage your budget and save. Be open to the idea that you have to learn new ways to handle your finances and debts that you didn't use before.

  1. Pay Off Highest Interest Rates

Perhaps you're able to pay off some of your debt. This doesn't mean you're able to pay it all off. It's important to keep current with as many monthly payments as you can as you work your plan out. If you have any extra that you can use to pay down debts, always target the debt with the highest interest rate first. That higher interest rate will build up more debt faster than lower interest rates will, so it's important to quickly cut down what you owe here.

  1. Cancel the Things You Don't Need

There are a lot of things we enjoy, but don't really need. Perhaps this means cutting cable TV out of your budget. This alone can save you more than $100 a month. Be strategic about this. You still need internet access to apply to jobs, so it's reasonable to pay for this service. You don't have to cut everything, just those things you can live without: meals out, trips to the movies, new electronics, etc.

  1. Come Up with a Plan

Whichever solution you choose, you need a plan to see it through to its conclusion. You don't have to come up with that plan alone. Meet with a credit counselor. They'll be able to provide critical, and understandable, debt/budget education and they can help you formulate a workable plan to regain control of your finances.

  1. Consider an Attorney

Bankruptcy attorneys will often offer a free consultation, which can help you determine if bankruptcy is a suitable choice. Being in debt doesn't mean you have to be desperate.

Also, make sure the lawyer is a suitable choice too! Don't just take the first attorney who comes along. Ensure you select someone with whom you can work and who understands your situation without judgment.

If you decide not to pursue bankruptcy, then you don't need an attorney or the associated expense when you choose debt consolidation or debt settlement.

  1. You May Not Be Able to Discharge Tax Debt

If you're looking to discharge tax debt through bankruptcy, you'll need to speak with an IRS tax attorney. Most tax debt is difficult to discharge this way; an IRS tax attorney will be able to tell you whether your debt qualifies or not.

Tax debt needs to be from income taxes, at least three years old, and assessed by the IRS at least 240 days before the filing of your bankruptcy petition (tax debt that's not yet assessed may also qualify).

You must have filed a tax return at least two years before filing bankruptcy, and you must not have committed fraud or willful evasion. Failing any of these standards means that your tax debt cannot be discharged under Chapter 7 bankruptcy.

Chapter 13 bankruptcy has different, stricter standards that are to some extent at the discretion of a judge.

  1. Bankruptcy Will Not Discharge Alimony or Child Support

Alimony cannot be discharged through bankruptcy. Neither can child support, or back payments owed. This would be unfair to the supported spouse or child. Bankruptcy will not impact your alimony or child support payments.

The only way alimony is discharged under bankruptcy is if a third party (such as the filer's parent) agrees to pay it on behalf of the filer.

  1. Bankruptcy Can Impact Employment Opportunities

Bankruptcy isn't supposed to impact your chances at getting a job in the future. It's technically illegal for most employers to factor this into their hiring choices. That said, it's hard to prove, and some businesses will be less likely to hire you if you have a bankruptcy show up on your background check.

Some businesses will act with good faith and follow these rules; others won't. The same goes for someone who might rent to you. They're not supposed to consider bankruptcy, but they may anyway.

This stigma is not fair, but it is a consideration to factor into your decision. Solutions like debt settlements and debt consolidation don't carry the same stigma as bankruptcy and may be more favorable options depending on your circumstances.
