Should-I-File-Bankruptcy--Personal-Bankruptcy--Fast-Track-Debt-Relief 7 Reasons Bankruptcy Is a Bad Idea

Should I file bankruptcy? It's a tough question to answer. Personal bankruptcy is intimidating. Often, people in debt aim straight toward this last resort without learning of other options that can help them get out of debt. Additionally, they may not fully understand the terms of the agreement: Why is this asset being liquidated? Why isn’t this debt cleared?

Personal bankruptcy can be the best route for some, but it can signal a wrong turn for many others. There are 7 things you must know about this option before pursuing it further.

  1. Bankruptcy Is a 10-Year Commitment - A bankruptcy remains on your credit report for as long as 10 years. This can impact your ability to secure future loans and favorable terms on credit cards.

    You also can't file bankruptcy again for another six years, so you have to consider timing and whether right now is the best moment to take this on. A major lifestyle change is necessary; you have little room to make financial missteps.
  1. You Will Lose Your Credit Cards - You won't be able to choose which credit cards you keep. All your credit cards will be closed out. It can take some time (about one to three years) to regain unsecured lines of credit, and when you do, these lines of credit will have particularly high interest rates. It will take a significant amount of time to improve your credit to the point where you enjoy low interest rates again.

    It will also be nearly impossible to secure a mortgage for quite some time. Many loans will be either impossible to get, or will have exceptionally disadvantageous terms.
  1. Your Employment Chances May Be Affected - When potential employers perform background checks, it is illegal for them to factor your bankruptcy into their hiring decision. They may anyway, and there's not often a real way to catch them out on this. They're smart enough to come up with a different, legal reason for not hiring you – but the real reason may simply be the bankruptcy on your background check.

    This can be particularly prevalent in jobs where you have access to money or others' financial details. If you are engaged in a job search after declaring bankruptcy, and the potential employer is performing a background check, it's best to be candid about your situation and speak honestly about what you're doing to recover.
  1. Bankruptcy Won't Clear Certain Debts - Some look to personal bankruptcy as a way of zeroing out debts like alimony or child support. That’s not going to happen. You can only suspend these obligations through family court, and they won't always consider the same factors that bankruptcy does. This is done so that people can't take advantage of bankruptcy to dodge certain responsibilities. It also keeps those receiving alimony or child support safer, and gives them recourse to be heard.

    Bankruptcy won't eliminate student loan debt either. The same may hold true for a mortgage lien and certain other debts. In other words, it is not a “get out of debt free” card.
  1. Your Assets Can Be Taken - Chapter 7 bankruptcy can be powerful for certain situations. It erases debts including medical bills, personal loans, and credit cards. However, states have a variety of different exemption laws that decide whether your assets are protected.

    Exemption laws generally protect a car, retirement accounts, and household goods. These are items essential to your everyday life. They also protect certain items with high sentimental value, such as wedding rings. However, they won't necessarily protect extra vehicles, ATVs, RVs, golf carts, or boats. These will be seized and re-sold by your bankruptcy trustee.

    The only way to save these items under a bankruptcy would be a Chapter 13 bankruptcy, but this ties you to a payment plan that may be difficult to meet.
  1. You Can't Transfer Assets - If you attempt to transfer assets before a bankruptcy, this may be deemed a fraudulent transfer. For instance, you may think it's a good idea to transfer the title of a vehicle over to a family member. If you do this anytime within two years prior to a bankruptcy filing, the transfer will likely be considered fraudulent.

    The law doesn't consider the honesty of your intent. It simply considers the action. For instance, if you transferred the title to a vehicle a year ago thinking your financial situation was on the upswing, the transfer can still be considered fraudulent.

    A court can undo any transfer that happened within this time frame, deeming the asset you transferred unprotected – which means it can be seized and re-sold by your bankruptcy trustee.
  1. You Can't Repay Debts to Family or Friends - Similarly, if you pay a debt to family or friends, this can be interpreted along the same lines. Let's say you owe your sister $2,000. You repay this before you file bankruptcy so that she can get back what you owe her.

    Yet if you pay your sister $2,000 and you don't pay a credit card debt, this is considered preferring one creditor over another. If you've done this within a year prior to filing for bankruptcy, a creditor can ask the court to take this money back and distribute it evenly between all creditors owed.

    Yes, this means they would be taking the money back out of your sister's pocket and re-distributing it. This law exists so that all creditors have equal access to repayment. It also means that you can't use debts and repayment to stow money away with friends or family.

There's a lot to consider before you ask yourself, “Should I file bankruptcy?” Create a budget, see a credit counselor, learn about debt relief options, and learn about bankruptcy in more depth.

That sounds like a lot, but understanding the process of personal bankruptcy and its alternatives can help you avoid a mistake that you’ll be paying for - literally and figuratively - for years to come.
